Military Injury & Accident Claims

Sometimes, failures by the Ministry of Defence (MOD), your commanding officers, or third‑party contractors can cause or contribute to an injury. What is a military injury claim?

A military injury claim is a type of personal injury claim that seeks compensation for the harm you’ve suffered and the financial impact it has had on your life. This can include:

  • Lost income and career progression
  • Loss of employment benefits
  • Pension loss
  • Medical and rehabilitation costs
  • Long‑term care and support needs

Where your military career has been cut short or significantly affected, the financial value of your claim may be substantial. To succeed, you will usually need to show that your injury was caused or made worse by someone else’s negligence.

Common causes of military injuries

Military injuries can happen in many different circumstances. You may have a claim if, for example:

  • You were injured during training due to unsafe practices or inadequate supervision
  • You were assaulted, bullied or harassed while serving
  • You were involved in a collision such as a vehicle or aircraft
  • You were issued faulty, defective or inadequate equipment
  • You were exposed to hazardous conditions without proper protection
  • You suffered an injury that could have been avoided with appropriate risk assessments or safety measures
  • You experienced hearing loss, a lifting injury, or another injury caused by repetitive physical strain
  • You experienced a psychological injury after a traumatic event whilst serving
  • You were injured because medical treatment or support fell below the standard it should have been

If any of these situations apply, it may be possible to hold the MOD or another responsible party accountable.

Armed Forces Compensation Scheme (AFCS) and War Pension Scheme

In addition to a civil claim, you may also be eligible to apply for compensation through:

  • The Armed Forces Compensation Scheme (AFCS)
  • The War Pension Scheme (WPS)

These schemes operate separately from civil claims, and in most cases, you can pursue both at the same time. They provide compensation for injuries, illnesses or conditions caused by service.

Time limits

Time limits will apply to civil claims and these are normally three years from the date you were injured. There may be ways to extend time to bring a claim in special circumstances. You should discuss this with a solicitor as soon as possible so that you can explore your options.
