Tom Jenkinson, Senior Lawyer in Bolt Burdon Kemp’s Costs department, writes for the Lexis Nexis Personal Injury Update on the effect the decision in his case of Adelekun v Lai Ho, in which the Court held that the Claimant was entitled to be paid costs on a standard basis after accepting a Part 36 offer, in circumstances where the Defendant had agreed that standard costs would apply, despite the case otherwise falling under the fixed costs regime.
