Personal Independence Payment

The Welfare Reform Act 2012, which received Royal Assent on 8th March 2012, provides for a new benefit called “Personal Independence Payment”. This is due to replace Disability Living Allowance for individuals aged between 16 and 64.

All individuals in the above mentioned age group receiving Disability Living Allowance will be asked if they want Personal Independence Payment, and then assessments will be carried out as necessary. If a person is not entitled to Personal Independence Payment, they will not continue to receive Disability Living Allowance instead.

So, just because an individual is receiving Disability Living Allowance, this does not mean that they will be able to claim Personal Independence Payment.

Awards of Personal Independence Payment will be made up of a Daily Living component and / or a Mobility component, each of which have two rates – standard and enhanced.

The replacement will start from April 2013 in some parts of the country. The aim is that from June 2013, individuals all over the country will be able to claim for Personal Independence Payment.

The third consultation on Personal Independence Payment, which began on 26th March 2012, is open until 30th June 2012.

For the sake of all those affected by the changes, including many of our clients, let’s hope these changes are not for the worse.
