What is Spinal Injury?

A spinal cord injury can be caused by a trauma, such as an accident or medical mistake, or as a result of infection or disease. The damage to the spinal cord disrupts communication between the brain and the body. When this happens it can result in a total or partial loss of movement and sensation below the point where the spinal cord has been damaged. As well as the loss of movement and sensation a spinal cord injury can cause a loss of bladder and bowel control, changes in sexual function, extreme pain, and problems with regulating your breathing or blood pressure. Can I claim for Spinal Injury?

Spinal injuries that you may seek compensation for typically fall under two categories: spinal injuries that occur (or worsen) due to negligence during medical treatment and spinal injuries that occur due to accidents. You may find it helpful to learn about the distinction between the two as it may help you better understand the spinal injury compensation claims process. We cover the two circumstances in detail below.

Spinal injuries caused by medical treatment

We can help bring a spinal injury claim for both adults and children if you experienced a spinal injury due to negligent medical treatment, or an existing injury is made worse due to negligent treatment. This could include:

  • Sub-standard surgical treatment resulting in paralysis or a spinal cord injury
  • Paralysis after scoliosis surgery
  • Delay in diagnosis or failure to diagnose medical conditions, for example or cauda equina syndrome
  • Missed fractures of the neck and back
  • Errors when handling patients with neck and back fractures
  • Failure to obtain informed consent
  • Provision of inadequate advice and information about a treatment or procedure
  • Failure to properly treat secondary complications such as pressure sores .

Our specialist solicitors are experienced in succeeding with these often-complex claims and are sensitive to your particular concerns.

Spinal injuries caused due to an accident

We can help bring a spinal injury claim if you or your child have sustained a spinal injury due to an accident. Some examples of accidents that we can bring a spinal injury compensation claim for include:

Spinal injury claims of this nature are often complex. Our specialist solicitors have years of experience succeeding with these claims and take care to accommodate any particular concerns you want addressing.

Client Journeys

Our client was a rear seat passenger in a vehicle where the driver fell asleep at the wheel and the car was involved in an accident. Our client sustained a complete spinal cord injury resulting in paraplegia. At a Joint Settlement Meeting the parties agreed a settlement figure of £10 million which will ensure our client has the funds they need to have the best quality of life possible for the remainder of their life.
