Claire Withey

Claire is an Associate Solicitor in the Military Claims Department at Bolt Burdon Kemp, having joined the firm in August 2016. Claire qualified as a Solicitor in September 2009.

Claire specialises in pursuing both Personal Injury and Clinical Negligence claims on behalf of former and serving Military personnel and their families. Claire has a strong background in both Claimant and Defendant litigation.  She has extensive experience in dealing with claims relating to orthopaedic and spinal injuries and has achieved some high settlements for her clients with care packages which will support them in their daily lives both now and in the future.

Prior to joining Bolt Burdon Kemp, Claire trained and qualified at a Defendant firm specialising in defending claims against various NHS Trusts.  She then moved to a Claimant firm and gained four years experience in pursuing Clinical Negligence claims on behalf of individuals.  She also represented the interests of individuals at inquests.

Claire is putting her previous experience into practise in bringing complex claims against the Ministry of Defence involving training incidents/defective work equipment and military road traffic accidents.  Claire also deals with complex military medical negligence claims, such as the delay in diagnosing cauda equina syndrome and complex chronic compartment syndrome. Claire has a particular interest in claims involving complex psychiatric injury.

She is tenacious, but approachable and works hard to achieve the very best for her clients.

Claire is a keen runner having undertaken several 10K runs and half marathons for various charities.  She was a member of the CSR committee at her previous firm and was heavily involved in fundraising for Action For Kids, a charity aimed at helping disabled children and young adults.  She now intends fundraising for military charities who help her clients.

  • Claire was fantastic.  I found that she was always accessible, not just in office hours but she would also email me over the weekend too, and this flexibility was very much appreciated by me.

  • Everyone at BBK who worked on my case was very professional.

  • Claire was fantastic, very professional, available to answer any query I had, whenever I needed her and was always happy to help.

  • My wife and I can’t thank the BBK team enough, especially Claire, Rhicha and Charlotte who took on my case to closure, all three ladies have always been throughout my claim, professional, understanding, diligent, caring and honest at all times, a true credit to the firm, I was recommended to use BBK by a friend and I would also give BBK my full recommendation to any one reading this. The team kept us fully informed throughout the case with clear explanations as to case status and implications of decisions we had to make.  We truly felt that we were always given very clear information and the best advice, we were always kept fully informed.  We always had the opportunity to ask questions and responses were very quick when we did. Thank you again

  • I have no hesitation in recommending Bolt Burdon Kemp as the legal firm any serving or veteran service personnel should contact in the event that they may need to take legal action against the MOD. From initial contact, to my case being resolved almost 5 years later, every person I have dealt with at the firm, from reception staff to partner level, have been professional, courteous and above all respectful and understanding with all aspects relating to my case.
