Ben is a Senior Associate Solicitor in the Accident Claims department at Bolt Burdon Kemp.  He joined the firm as a newly qualified solicitor in September 2013.  Since then he has developed considerable expertise in personal injury claims.

Ben specialises in accident claims, in particular those involving road traffic accidents and accidents at work.  Ben represents both adults and children, all of whom have suffered life-changing injuries.  Ben has a keen interest in acting for those who have sustained multiple orthopaedic injuries and amputations.  He also handles fatal accident claims and in recent times has taken on claims involving e-scooters.

Since joining Bolt Burdon Kemp, Ben has secured a large number of settlements.  Notable cases that he has worked on include:

  • Representing a gentleman who was severely injured in a motorcycle accident.  After undergoing in excess of 25 operations in an effort to save his injured leg, Ben’s client and his surgeons made the decision to amputate.  The client went on to make an excellent recovery with the use of prosthetics.  A settlement in excess of £2.5 million was agreed at a meeting with the Defendant’s representatives.
  • Acting for a caretaker of a church who fell 20 feet from a ladder.  The gentleman suffered significant and multiple fractures to both legs.  An external cage was fitted to his lower left leg, his left ankle was fused and plates and screws were inserted into his right foot. Ben secured interim payments and case management support for his client before ultimately achieving a settlement of £560,000.
  • Representing a woman who sustained life-changing pelvic and spinal injuries after being run over by a van.  Following numerous operations, Ben’s client was left with permanent mobility issues and continence issues.  After gathering all of the necessary medical evidence, Ben settled this claim for just under £500,000 and the client was very happy with the result.
  • Ben represented an employee of a crane company who was involved in a serious accident at work.  He suffered a crushing injury to his hand, which resulted in the partial amputation of three of his fingers.  Ben achieved a swift settlement of £210,000 for his client, which compensated him for his various losses including his disadvantage on the labour market and future prosthetic costs.
  • Representing a cyclist who suffered a broken shoulder when driver of a vehicle travelling in the opposite direction turned right across his path. Ben’s client underwent surgery to insert metalwork into his shoulder.  His injuries disrupted his degree studies and his work as a driving instructor.  The client approached Ben after being dissatisfied with his previous solicitors.  Ben took over conduct of the claim and after gathering expert evidence negotiated a favourable settlement of £170,000.
  • Acting for a motorcyclist who was involved in a collision with a van, which pulled out of a side road.  Ben’s client suffered multiple serious injuries, including a brachial plexus injury, which prevented him from pursuing his career as a trader.  Ben obtained regular interim payments for this client as well as a sizeable settlement of £700,000.
  • Representing an employee who worked as a brick cutter who suffered serious injuries to two of his fingers.  Whilst cutting bricks Ben’s client’s right hand was pulled sharply into a circular saw.  The terminal phalanx of his middle finger was amputated and his index finger was severely fractured. During the course of the claim, Ben arranged for his client to trial a high-definition silicone prosthetic finger, which greatly improved his confidence.  Soon after commencing court proceedings a settlement of £140,000 was reached.
  • Ben represented a cyclist who was knocked down by a vehicle, which failed to stop a T-Junction.  The driver drove over the cyclist causing her to suffer a de-gloving injury of her lower left leg and a fractured fibula. She underwent numerous operations including a skin graft from her thigh to her lower leg. The incident prevented Ben’s client from continuing with her hobbies of cycling and yoga for a long time. Although her mobility improved, she was left with permanent scarring. Ben negotiated a favourable settlement of £140,000 within just one year of being instructed.

In addition to his casework, Ben attends meetings held by the Limbless Association, a charity that provides hands-on support for amputees and their families.  Bolt Burdon Kemp are on the charity’s legal panel.  Ben has raised money for them by helping to organise both a Six Peaks Challenge and a 4x4x48 event, which raised thousands of pounds for the charity.

As Coordinator of the Association of Personal Injury Lawyers (APIL) Transport Special Interest Group, Ben arranges for speakers to present to APIL’s members on transport related topics. Recent presentations have included driverless cars, motorcycle collisions, micromobility and aviation claims. Also as part of this role, Ben has contributed to APIL’s responses to Government consultations on a variety of transport related issues such as roads policing, a review of The Highway Code, automated vehicles and mobile phone usage.

In recent times, Ben has developed a keen interest in the development of the law surrounding the use of e-scooters in public places. Ben has provided a huge amount of commentary in the media on this subject. He has also discussed the issue in interviews with Andrew Castle on LBC radio and on the Electroheads YouTube channel.
