Trust to pay out millions for medical negligence

West Hertfordshire Hospitals NHS Trust has accepted partial liability for mistakes made during the birth of a six year old girl that have left her with severe brain damage.
Antonia Caddock was born via emergency caesarean section, but complications meant she was left without oxygen and as a result she will need 24-hour care for the rest of her life, the Watford Observer reported.
As a result of this, Ms Caddock brought a claim for medical negligence against West Hertfordshire Hospitals NHS Trust, both for the brain damage her daughter suffered and injuries she herself suffered during the delivery. Although the Trust did not accept full responsibility, it has now offered to settle both claims on the basis of 40 per cent liability. Although the final sum to be awarded will not be known for some time it is likely that the award will be several million pounds due to the extent of the injuries sustained by Antonia and the fact she will need care for the rest of her life.
