Cycling without a helmet

Insurers will always try to take 25% from cyclist’s compensation if they weren’t wearing a helmet. In fact, insurers have to show that the injuries probably wouldn’t have happened if the cyclist was wearing a helmet.

As there is no legal obligation on cyclists to wear a helmet, a client recently asked why car drivers didn't get deductions for not wearing a helmet. This is a good point, but as drivers have seat belts, helmets are not deemed necessary. However, what would happen if the Highway Code recommended drivers wear a helmet? Maybe insurers would try to deduct compensation from drivers for not following the guidelines as well!
