Repeal of the Human Rights Act 1998?
May 24, 2010
You may have seen the news that the Tories are proposing to repeal the Human Rights Act 1998, with a 'British Bill of Rights'. The current legislation incorporates fundamental rights enshrined in the European Convention into domestic law. The Tories say that under the current law, the British courts find it hard to extradite criminals. On Tuesday two terror suspects successfully appealed against deportation to Pakistan, arguing that they face death or torture. Whatever your view, it will be interesting to see what happens and of course, for us as lawyers, what the impact is for Claimants obtaining compensation for a breach of their rights.
