Professional negligence claim payout of £36,000

I have just read about a case in which a cleaner had an industrial disease case against his former employers. His solicitors commenced proceedings on his behalf, however it came to light that they had missed the limitation period for issuing his claim in Court. The solicitors therefore dropped his case and deprived their client of the chance to obtain damages against his employer. Limitation deadlines are extremely important and if you think you have a claim you should seek advice as soon as possible. Thankfully for this individual, he had sought advice and it was his solicitor's fault that action was not taken within the strict time limits laid out in the law. He successfully pursued his solicitors for professional negligence and obtained a damages payout of £36,000. At least in this instance the actions of his first firm of solicitors did not prevent him from obtaining access to justice.
