Personal trainer paralysed in a ski-doo accident to claim substantial damages

A High Court judge has found the holiday company Inghams to blame in a skidoo accident which left a woman paralysed.The case was brought by Emma Moore following a skidoo excursion at the Passo Torale ski resort in Italy. The High Court ruled against Inghams after finding that they were providing the excursion and not simply acting as an agent. That meant Ms Moore could bring proceedings in England because the Package Tour Regulations applied. Although it is too early to say what the value of the compensation might be, it is expected to be “very substantial”. Inghams have already said they will appeal against the decision and - if so - the Court of Appeal is expected to make a decision in about six months time. If this decision is upheld operators will need to consider whether or not to allow holiday reps to offer excursions as they could find themselves being held responsible for any injuries that arise.
