No solicitor means no professional negligence protection

The economic slowdown has seen increasing numbers of people attempting to save money on legal fees by carrying out their own conveyancing for the sale or purchase of property.

The risk of making a very damaging mistake is relatively low, but if a mistake is made the consequences can be disastrous. Whilst most transactions are straightforward, the solicitor adds value to the consumer by identifying problems in the minority of cases. Even if the solicitor does not spot problems, such as defects in title or an unusual transaction history suggesting overvaluation, the consumer can look to the solicitor for compensation if the mistake is his. The law expects coneyancers to carry out work to the standard of a “reasonably competent solicitor” which is interpreted as very high standard. Any defect that is apparent from documents on file, however obscure, is likely to lead to a finding of negligence.
