Aeroplane and aviation accidents abroad

Tens of thousands of people in the UK choose to travel abroad by aeroplane every year.

If you have been involved in an accident onboard an aeroplane, whether while embarking, disembarking, or during the journey, then you may be able to claim compensation.

The Montreal Convention on International Carriage By Air (which mostly supersedes the Warsaw Convention) is an important international convention and may apply to compensation claims brought by airline passengers. The time limit for bringing a claim under this convention is 2 years.

In most cases, these conventions allow you to bring a claim for bodily injury without having to prove fault on the part of the airline, but rather that the incident falls within the definition of an air accident. International conventions usually have precedence over national law and because they apply to passengers, the position could be different for people working aboard the aircraft, such as air-stewards.
