Sarmad Gassoub is a solicitor at Bolt Burdon Kemp specialising in personal injury and clinical negligence claims.
Sarmad read law at the University of Kent at Canterbury before completing his studies at the College of Law in London with commendation.
Sarmad was trained and later retained as a solicitor at Anthony Gold Solicitors after he qualified in 2004 under the supervision of the then President of the Association of Personal Injury Lawyers, David Marshall. Here he cut his teeth working on a series of varying types of claim including:-
Road traffic accident claims - from minor whiplash type injuries to claims of the upmost severity. During his tenure, Sarmad worked on a claim brought under the Motor Insurer’s Bureau uninsured driver’s scheme in which the Defendants to the claim failed to make any reasonable offer of settlement leading to the case being run to trial and an award in excess of £300,000 being paid to the Claimant – a keen motorcyclist who sustained severe ankle injuries that permanently altered his gait and ability to mobilise with ease.
Accident at work claims including cases involving faulty work equipment and /or unsuitable working environments. Amongst his key claims included a stonemason at a Paddington construction site whose dominant thumb was crushed at work as a result of a failure by his employers and their head contractors to ensure that his workplace was kept safe, tidy, and clear of obstruction. Sarmad was able to secure a compensation award of £90,000 for this client. He also acted for a London waitress who slipped on a food spillage during the course of her employment and fell onto her coccyx, whereupon she developed a pain syndrome known as a Somatisation Disorder which had no organic basis but left her with ongoing crippling pain across her spine. This client was awarded £100,000 upon later settlement of her claim.
Public liability claims – including clients who tripped and slipped on defective publicly maintained pavements and roads.
Claims run under the Criminal Injuries Compensation Authority Scheme. Sarmad has experience appealing adverse Authority decisions and during his tenure at Anthony Gold was able to secure an additional £30,000 award to the Applicant’s injury award having made a successful appeal to the Authority’s panel.
Clinical Negligence claims (including those involving sub-standard obstetric intervention resulting in the development of conditions such as cerebral palsy and erbs palsy), negligent cosmetic surgery and dental claims.
From February 2008 until March 2009 Sarmad moved to work at Thompsons Solicitors in Chelmsford where he took on a large Trade Union related caseload of accident at work claims and furthered his niche understanding and implementation of the complex regulatory framework inherent in these sorts of cases. Amongst his cases included a warehouse engineer who suffered from Post Traumatic Stress Disorder as a result of 2 separate ‘near miss’ accidents at work involving near death experiences and a factory worker whose foot was crushed by metal component resulting in permanent complex regional pain syndrome which left him out of work for over 3 years.
Sarmad recently joined Bolt Burden Kemp in March 2009, and has a mixed personal injury / clinical negligence caseload. He was recently involved in a road traffic accident claim involving a brain injured client requiring 24 hour one-to-one care for the remainder of her life. An amicable settlement was reached with the Defendant’s insurers whereby the Claimant’s representatives agreed to accept the sum of £5.4 million in settlement of her claim, most of which will be paid to the Claimant on a ‘periodical payment’ basis – i.e. an annual payment award indexed to inflation in order to ensure that it keeps up with the rising cost of care in the future.
