The basics
Holidays abroad should be fun and enjoyable and an escape from the rigours and stress of everyday life. Unfortunately, every year large numbers of UK holidaymakers suffer from an injury or illness whilst abroad which can often ruin a holiday. Fortunately, for many a full recovery is made from their injury or illness suffered. For some people however, they may suffer ongoing health problems.
Claiming compensation for injuries and illness suffered abroad can be complicated for a number of reasons, including the various exclusions of particular types of injury under different international conventions, the difficulty in obtaining supportive evidence for incidents which have happened abroad, and the different time limits set for pursuing claims in other countries.
Even if your injury or illness happened abroad it may be possible to bring a claim in the UK, provided that the holiday was booked as part of a package tour holiday and it meets the appropriate criteria. If the injury or illness happened on a holiday that was not a package holiday, you may still be entitled to bring a claim in the country where the incident occurred.
The level of compensation awarded for injuries and illness suffered abroad will depend on the circumstances of each individual case, including the extent of your injury and any financial losses you have sustained.
