Accident on boarding an aircraft

Our client was a passenger on a British Airways flight from Tel Aviv to London. On boarding and before take off she was hit on the head by an overhead locker. Our client was recovering from major brain surgery at the time and had recently been discharged from hospital in Tel Aviv. She alleged that the blow to her head had caused a relapse of symptoms including seizures (fits) which the surgery had been meant to rectify. She also reported problems with her sight, a lack of feeling in her right arm and leg, and became depressed. Under the Montreal Convention, our client was entitled to hold British Airways responsible for her injuries as these had taken place whilst boarding the aircraft. British Airways settled the action shortly after court proceedings were issued for a sum which we cannot disclose as our client is bound by a confidentiality agreement.

Back injury in hotel in Mexico

Mrs A injured her back when she slipped on a wet marble floor in a hotel in Mexico, just two days into her holiday. She had a very unpleasant time in a hospital in Mexico before she had to fly home. Her holiday was completely ruined. At home she managed to struggle back to work. Liability was never admitted for the accident which had to be dealt with under Mexican law but because Mrs A was travelling with a package tour she could take advantage of the Package Tour Regulations and was able to bring the claim in England. The claim was successfully settled for £12,500.

Dumper truck falls into a cable pit

Our client was employed as a ground worker at a construction site on Guernsey. He was driving a dumper truck moving soil from an excavation site to a spoil heap. The construction site had several cable pits which were not properly covered or marked. The ground beneath our client's truck gave way and the truck fell into a cable pit. Our client was thrown forwards and the left side of his chest hit the roll bar of the dumper truck. He suffered a back injury, several broken ribs and a haemopneumothorax which required hospital treatment and an operation. Our client tried to return to work but was unable to cope. The Defendant's insurers admitted liability for the accident and paid our client £70,000 in compensation for his injuries.

Fatal accident in Paris

We acted for the widow of a Euro Disney site worker who was killed in a road traffic accident in Paris whilst in a van driven by an English driver. We chose to sue in England. It was necessary to liaise with French lawyers as the accident was caused by a motorcyclist insured by a French insurance company. Damages were very substantial as the widow and her child had been deprived of the victim's financial support.

Mrs D injured her ankle whilst on a cruise ship holiday with her husband. The accident occurred when Mrs D tripped over a step in the restaurant on the cruise ship. Liability for the case was never formally admitted but the client was travelling with a package tour, so she was able to take advantage of the appropriate Package Tour Regulations and successfully settle her claim in England.
